Panama & Central America – Real Estate Investments


With property values in parts of the world hitting record highs, many real estate enthusiasts are opting to purchase beautiful homes in Central America’s “Panama”. Wealthy foreigners are flocking to Panama from all over the world—America, predominantly—for several reasons:

Did you know that foreigners can own property in Panama with very few restrictions? Today, ownership can be achieved in two different ways:

1. Title
2. Rights of Possession.

(The most important difference between these two forms of Panama ownership is that “Rights of Possession” cannot be mortgaged, thus many foreign investors opt for “Title”)

Titled property is treated similarly to U.S. real estate law. Deeds are recorded in the public registry—or "registro Público" in the local tongue—while “Rights of Possession” are handled and recorded by Panama’s agriculture department. This system was originally set up in the land reform of 1971 to encourage migration to unclaimed or untitled land. Most of the land traded in the islands is by right of possession with the exception of town, proper.

Constitutionally the government cannot take possession of private property without following a condemnation process similar to the U.S. policy; the owner must be compensated for all land and improvements made at a fair market value.

Since all Panama beaches are public, Panama law requires that all beachfront properties provide a right of way (via walk way, trial, road, etc) from the highest tide point to the property line.
